On 25 November 2009 the Australian Competition Tribunal (Tribunal) made orders varying some aspects of the AER's New South Wales distribution determination 2009–10 to 2013–14. One element of these orders was that the AER’s decision in respect to Ausgrid's (EnergyAustralia’s) alternative control (public lighting) services be remitted back to the AER to make the decision again in accordance with the Tribunal’s directions.
The Tribunal has directed the AER to undertake its re-determination in accordance with the following timetable.

On 7 January 2010, Ausgrid (EnergyAustralia) submitted its public lighting services proposal together with supporting information to the AER. In accordance with the Tribunal’s orders, the AER has published EnergyAustralia’s non-confidential public lighting services proposal.
