On 17 July 2020, the Australian Energy Regulator (AER) considered and approved Total Gas & Power Australia Pty Ltd.'s (TGPAU's) application to repeal its individual exemption in accordance with clause 20 of schedule 2 of the National Gas Law.
Background
On 16 December 2014, the AER accepted an application from TGPAU for an individual electricity exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law.
Submissions closed 23 January 2015. No submissions were received.
On 6 March 2015, the AER granted an exemption to TGPAU for the sale of electricity.
Cancellation of exemption
On 4 May 2020, the AER accepted an application from TGPAU to cancel the individual exemption it was granted on 6 March 2015.
The AER, under section 20 of the National Gas Law and section 8 of the National Energy Retail Law, has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
Submissions closed 2 June 2020. No submissions were received.
