On 17 September 2019, the AER approved SAS Trustee Corporation's (SAS Trustee) application for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law.
Background
On 13 March 2019, the Australian Energy Regulator (AER) accepted an application from SAS Trustee Corporation for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law to sell energy at Plumpton Marketplace, Plumpton NSW.
Submissions on SAS Trustee Corporation's application closed on 12 April 2019. No submissions were received.
Cancellation of Exemption
On 22 December 2023, the AER accepted an application from SAS Trustee to cancel its individual exemption. SAS Trustee requested the cancellation of the exemption on the grounds that the site is under new management and energy is now being supplied by Lendlease Property Management (Australia) Pty Limited / ABN 61 002 894 153.
The AER, in accordance with clause 20 of schedule 2 of the National Gas Law (as applied by section 8 of the National Energy Retail Law), has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
