On 19 December 2005, the AER approved a variation to an existing exemption granted by NECA to Rail Access Corporation. The variation was sought due to a restructuring of the NSW rail sector and the entities that own and operate rail infrastructure in NSW, including the associated electricity distribution network. The previous exemption dated 15 June 2000 was repealed and a new exemption was granted to the current applicants. The exemption was granted under clause 2.5.1 of the NER in accordance with the AER's former Electricity NSP Registration Exemption Guideline, and is subject to the conditions set out in the Exemption Instrument.
