On 26 June 2013 the AER approved the Applicant’s exemption from the requirement to register as a network service provider and the operation of Chapter 5 of the NER. The variation was sought due to a restructuring of the NSW rail sector and the entities that own, operate and maintain the rail infrastructure in NSW, including the associated electricity distribution network. The previous exemption dated 19 December 2005 was repealed and a new exemption was granted to Sydney Trains. The exemption was granted under clause 2.5.1 of the NER in accordance with the AER’s Electricity NSP Registration Exemption Guideline, and is subject to a number of conditions.
