The AER is responsible for monitoring, investigating, enforcing and reporting on compliance with the National Energy Retail Law (Retail Law), National Energy Retail Rules (Retail Rules) and applicable regulations. To support these roles, we have developed the AER Compliance procedures and guidelines (the Guidelines) to establish a self-reporting framework that applies to all retailers and distributors in jurisdictions that have adopted the Retail Law.
The Guidelines set out the manner and form in which regulated entities are required to submit information and data on their compliance to the AER, and the process for managing compliance audits under the Retail Law.
Improvements to the Guidelines will better enable the timely reporting of compliance matters, which will help the AER monitor, investigate, and enforce compliance with obligations under the Retail Law and Retail Rules. The information will also assist the AER in carrying out our work under our updated compliance and enforcement priorities.
The commencement date of Version 7.0 of the Guidelines is 1 April 2025. Version 7.0 of the Guidelines replaces Version 6.0 of the Guidelines. As part of the transitional arrangement, the quarterly report for the period 1 January to 31 March 2025, required under Version 6 of the Guidelines, must be submitted to the AER no later than 30 April 2025.
