The Registrant’s exemption from the requirement to register as a network service provider and the operation of Chapter 5 of the NER has now come into effect. The exemption was granted under clause 2.5.1 of the NER in accordance with the AER’s Electricity NSP Registration Exemption Guideline (Network Exemption Guideline), and is subject to a number of conditions. Note that an exemption in class NRO6 (i.e. a large dedicated connection asset) is not exempt from the operation of the whole of chapter 5. It is deemed to be subject to the condition that they comply with:
- clause 5.2A.8 of the NER (the access framework for large dedicated connection assets);
- clause 5.2A.6(c) of the NER (a requirement to comply with its access policy and the negotiating principles in schedule 5.12 of the NER if an applicant seeks large DCA services; and
- rule 5.5 of the NER (commercial arbitration for large DCA services), as if that person were a Dedicated Connection Asset Service Provider.
