On 11 November 2021, the NSW Department of Planning, Industry and Environment requested that the AER determine whether the scheme established under section 58(1) of the Electricity Infrastructure Investment Act 2021 (NSW) (EII Act) is a jurisdictional scheme.
The scheme is part of NSW’s Electricity Infrastructure Roadmap (Roadmap) and allows for costs associated with the EII Act to be recovered through NSW Distribution Network Service Providers (DNSPs).
The AER must assess all requests for jurisdictional schemes under the National Electricity Rules (NER).
Where a scheme meets the NER’s eligibility criteria, the AER must decide that the scheme is a jurisdictional scheme. As the AER is satisfied that the NSW Government’s request meets the relevant criteria it has decided that the scheme is a jurisdictional scheme.
We have been appointed under the EII Act to make an annual contribution determination which is the amount to be recovered from NSW DNSPs based on information provided by the Roadmap’s independent Special Financial Vehicle. We will make the first contribution determination in 2023.
