On 11 November 2021, the NSW Department of Planning, Industry and Environment (DPIE) lodged an application for the AER to consider whether the scheme established under section 58(1) of the Electricity Infrastructure Investment Act (NSW) 2020 (the Act) is a jurisdictional scheme.
The scheme is part of NSW’s Electricity Infrastructure Roadmap (Roadmap) and allows for costs associated with the EII Act to be recovered through NSW Distribution Network Service Providers (DNSPs).
The AER must assess all requests for jurisdictional schemes under the National Electricity Rules (NER).
Where a scheme meets the NER’s eligibility criteria, the AER must decide that the scheme is a jurisdictional scheme. As the AER is satisfied that the NSW Government’s request meets the relevant criteria it has decided that the scheme is a jurisdictional scheme
A jurisdictional scheme makes recovery of scheme costs more administratively efficient for DNSPs and allows costs to be recovered through the AER’s annual pricing review assessments.
