On 5 September 2022, the Australian Energy Regulator (AER) considered and approved STUCCO Co-operative Ltd.'s application to repeal its individual exemption in accordance with clause 20 of schedule 2 of the National Gas Law.

Background

On 18 November 2016, the AER approved an application from STUCCO Co-operative Ltd for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law.

On 22 September 2016, the AER accepted an application from STUCCO Co-operative Ltd for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law to sell energy at 197-207 Wilson Street, Newtown NSW.

Submissions on Stucco Co-operative Ltd's application closed on 21 October 2016.

Variation of conditions 2021

On 20 July 2021 the AER proposed to vary the conditions of Stucco Co-operative Ltd's exemption. Submissions from interested stakeholders on the variation closed 13 August 2021. No submissions were received.

On 12 October 2021 the AER varied Stucco Co-operative Ltd's exemption conditions to include a new condition.

Cancellation of Exemption

On 31 May 2022, the AER accepted an application from STUCCO Co-operative Ltd to cancel its individual exemption. STUCCO Co-operative Ltd requested the cancellation of the exemption on the grounds that it is no longer engaged in the activity of selling energy as customers are charged a rental fee that includes energy costs.

The AER, in accordance with clause 20 of schedule 2 of the National Gas Law (as applied by section 8 of the National Energy Retail Law), has a general power to repeal any decisions that it is entitled to make.

The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.

Submissions from interested stakeholders on STUCCO Co-operative Ltd's application to cancel the exemption closed on 28 June 2022. No submissions were received.
