On 8 April 2016, the AER approved an application from Arc Energy Group Pty Ltd for an individual exemption from the requirement to hold an electricity retailer authorisation under the National Energy Retail Law.
Cancellation of Exemption
On 13 August 2021, the AER accepted an application from Arc Energy Group Pty Ltd (Arc Energy) to cancel the individual exemption it was granted on 8 April 2016 for the sale of electricity at GM Tower. Arc Energy requested the cancellation of the exemption on the grounds that it no longer owns or operates GM Tower and does not sell electricity at 11-15 Deane Street and 20 George Street, Burwood, NSW.
The AER, in accordance with clause 20 of schedule 2 of the National Gas Law (as applied by section 8 of the National Energy Retail Law), has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
Submissions from interested stakeholders on Arc Energy's application to cancel the exemption closed 10 September 2021. No submissions were received.
