Electricity distribution businesses are implementing the AER’s Ring-fencing Guideline this year. Full compliance is required by 1 January 2018. The distributors have recently submitted compliance plans to us as well as applications for waivers they are seeking from certain ring-fencing obligations. Both the compliance plans and the waiver applications are now published on our website.

We will assess applications consistent with clause 5 of the Ring-fencing Guideline. A draft decision will be published toward the end of September.

Invitation for submissions

Interested stakeholders are invited to make submissions on the waiver applications which we will take into consideration in preparing our draft decision. Alternatively, stakeholders may prefer to make a single submission on our draft decision which will provide our initial views on the waiver applications collectively. In either alternative, we will consider all submissions in making our final decision later this year.

Submissions on individual waiver applications are due by close of business on Friday 25 August 2017.

The AER prefers that all submissions be sent in an electronic format in Microsoft Word or other text readable document form and publicly available, to facilitate an informed, transparent and robust consultation process. Submissions will be treated as public documents unless otherwise requested. All non-confidential submissions will be placed on our website.
