On 11 November 2021, the Australian Energy Regulator (AER) considered and approved Stockland Property Management Pty Ltd.'s application to repeal its individual exemption in accordance with clause 20 of schedule 2 of the National Gas Law.
Background
On 26 February 2020, the AER approved Stockland Property Management Pty Ltd's application for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law.
On 4 December 2019, the AER accepted an application from Stockland Property Management Pty Ltd for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law to sell energy at Baulkham Hills shopping centre, 375-383 Windsor Road, Baulkham Hills, NSW.
Submissions on Stockland Property Management Pty Ltd's application closed on 13 January 2020. No submissions were received.
Cancellation of exemption
On 1 December 2020, the AER received an application from Stockland Property Management Pty Limited to cancel the individual exemption it was granted on 26 February 2020. Stockland requested the cancellation of exemption on the grounds that it no longer owns or operates Baulkham Hills shopping centre and does not sell electricity at 375 - 383 Windsor Road Baulkham Hills, NSW.
The AER, in accordance with clause 20 of schedule 2 of the National Gas Law (as applied by section 8 of the National Energy Retail Law), has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
