On 26 September 2019, the Australian Energy Regulator (AER) considered and approved Humenergy's application to repeal its individual exemption in accordance with clause 20 of schedule 2 to the National Gas Law.
Background
On 4 November 2014, the AER accepted an application from Humenergy Group Pty Ltd for an individual electricity exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law.
Submissions closed 3 December 2014. No submissions were received.
On 4 December 2014, the AER granted an individual exemption to Humenergy Group Pty Ltd for the sale of electricity.
Cancellation of exemption
On 16 August 2019, the AER received an application from Humenergy Group Pty Ltd to cancel the individual exemption it was granted on 4 December 2014.
The AER, under section 20 of the National Gas Law and section 8 of the National Energy Retail Law, has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
