On 7 July 2017, the Australian Energy Regulator (AER) approved an application from Atrio Apartments CTS 46116 (Atrio Apartments) for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law.
Background
On 17 May 2017, the AER accepted an application for an individual exemption from Atrio Apartments from the requirement to hold a retailer authorisation under the National Energy Retail Law to sell energy at 29 Robertson Street, Fortitude Valley, Queensland.
Submissions on Atrio Apartments application closed on 15 June 2017.
Cancellation of Exemption
On 22 November 2021, the AER accepted an application from Atrio Apartments CTS 46116 (Atrio Apartments) to cancel the individual exemption it was granted on 7 July 2017 for the sale of electricity at Atrio Apartments. Atrio Apartments CTS 46116 requested the cancellation of the exemption on the grounds that energy is now being supplied at 29 Robertson Street, Fortitude Valley, Queensland by an authorised retailer.
The AER, under section 20 of the National Gas Law and section 8 of the National Energy Retail Law, has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
