On 29 April 2021, the AER approved AMP Capital Investors Ltd's (AMP) application for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law at Marrickville Metro Shopping Centre, Marrickville, New South Wales.
Background
On 22 December 2020, the AER accepted an application from AMP for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law at Marrickville Metro Shopping Centre, Marrickville, NSW.
Submissions from interested stakeholders on AMP's application closed 2 February 2021. One submission was received.
Cancellation of exemption
On 26 April 2023 the AER accepted an application from AMP to repeal the individual exemption it was granted on 29 April 2021, for the sale of electricity at Marrickville Metro Shopping Centre. AMP requested its exemption be repealed on the grounds that it no longer owns or operates Marrickville Metro Shopping Centre and does not sell electricity at the site.
The AER, in accordance with clause 20 of schedule 2 of the National Gas Law (as applied by section 8 of the National Energy Retail Law), has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
