On 18 July 2023, the AER submitted a rule change request to the AEMC requesting the inclusion of negotiated transmission services within the scope of the Transmission Ring-fencing framework. The AER consulted with stakeholders on two proposed options, and ultimately requested that the AEMC implement Option 2: Expand the ring-fencing framework in clause 6A.21.2(a) of the NER to include the ability to ring-fence negotiated transmission services, in addition to prescribed transmission services. 

The AER has requested that the rule change be progressed as a 'fast track' rule change to reflect the extensive consultation on this issue which has already taken place.
