Project administration - Consolidation direction

On 16 April 2009 Jemena Gas Networks (NSW) Ltd (Jemena) requested that the AER direct it to consolidate its access arrangements for its four covered pipelines:

  • Wilton-Newcastle transmission pipeline
  • Wilton-Wollongong transmission pipeline
  • AGL NSW distribution system
  • AGL Central West distribution system

Under rule 53 of the National Gas Rules (NGR), the AER can direct a service provider to consolidate access arrangements, and may apply terms to the consolidation direction.

The AER sought comment from interested parties from 11 May to 22 May 2009. The only submission received was from Jemena. On 9 June 2009 the AER directed Jemena to consolidate its access arrangements, subject to certain conditions.

Project administration - Extension approval

On 16 April 2009 Jemena Gas Networks (NSW) Ltd requested that the AER extend the due date for submission of its access arrangements revision proposals from 30 June 2009 for two months. 

Under rule 52 of the National Gas Rules (NGR), the AER may extend the period for submitting an access arrangement proposal by up to two months. The AER sought comment from interested parties from 11 May to 22 May 2009. No submissions were received. 

On 9 June 2009 the AER granted the extension request, moving the scheduled date for submission of Jemena’s access arrangement revision proposals to be on or before 9.00 am A.E.S.T. on Wednesday, 26 August 2009.

Indicative timetable

The AER is required to make an access arrangement final decision within six months of receipt of Jemena’s proposal to approve or not approve the access arrangement proposal. This period can be extended by the AER but must be completed within 13 months. The AER is required to follow a prescribed decision making process under the National Gas Rules (NGR) when reviewing the access arrangement for the Jemena (NSW) Gas Networks. The indicative timetable outlines key stages in the review process.

Note: the AER has engaged consultants to assist it in its review different aspects of Jemena’s proposal including demand forecasts, operating expenditure and capital expenditure.

Stop the clock. The AER made the following decisions under rule 11 of the NGR.

Consultation process on access arrangement proposal. The AER decided that the period of 56 days for consultation on the proposal was not counted towards the decision making time for the full access arrangement final decision.

Consultation process on the draft decision. The AER decided that the period of 77 days for consultation on the draft decision was not counted towards the decision making time for the full access arrangement final decision. This also includes an overlapping period of 36 days for Jemena to submit a revised proposal.
