On 22 July 2015, Allgas Energy's gas distribution network became subject to light regulation, following the NCC’s Final Determination on 28 April 2015. The AER is no longer responsible for approving access arrangements but the AER is available to arbitrate in case of a dispute.
Background
On 17 June 2011 the AER released the approved access arrangement for APT Allgas Qld gas distribution network for the period 1 July 2011 to 30 June 2016. The access arrangement proposal establishes the basis for the terms and conditions of access for users and prospective users for the pipeline.
The decision was subsequently the subject of an application for review in the Australian Competition Tribunal (Tribunal).
On 10 February 2012, the Australian Competition Tribunal (Tribunal) made its final determination in relation to the access arrangement made by the AER in June 2011 for the Qld gas distribution network owned by APT Allgas. The determination varied the AER’s approach to calculating the allowance for the cost of debt.
Access arrangements pre-2011
Before coming under the regulation of the AER, gas distribution access arrangements for APT Allgas were approved by the Queensland Competition Authority (QCA).
