In assessing this application, the AER considered that the additional services enabled by a waiver would contribute to Ergon Energy Network (Ergon Energy) meeting the Queensland Government's policy and promoting the National Electricity Objective. The AER also considered the concerns raised in submissions about the possible harm to competition and concluded that under current circumstances, a waiver would have very limited impact.

On 22 August 2024 the AER granted a waiver, with conditions, for Ergon Energy to provide generation services in isolated networks using ‘behind the meter’ (BtM) renewable assets. The waiver will expire on 30 June 2030.
