On 7 December 2018, Evoenergy submitted an application to the AER under clause 6.6.1 of the NER for a positive pass through of costs arising from amendments to the Utilities (Technical Regulation) Act 2014 (the Act) which took effect from 1 July 2018. The Act imposes new regulatory obligations on Evoenergy to manage vegetation in specific areas within the Australian Capital Territory and inspect electrical infrastructure outside Evoenergy's network boundary.
On 6 February 2019, the AER determined that Evoenergy's application satisfied the definition of a service standard event and a positive change event under the National Electricity Rules. The AER approved a positive pass through amount of $2.40 million ($2018-19) to be recovered from network users in the regulatory years 2019-20 and 2020-21.
