Today the AER released its proposal to make the AER Compliance Procedures and Guidelines (Procedures and Guidelines) that apply to gas pipeline service providers.
This is the first stage of consultation and includes a proposed draft of the Procedures and Guidelines and Issues Paper.
The Procedures and Guidelines provide guidance and information to service providers about compliance with their requirements under the National Gas Law (NGL), the National Gas Rules, and the National Gas Regulations. The Procedures and Guidelines are required under section 64F of the National Gas Law.
We are seeking feedback on a number of issues, including:
- whether there is any further information that will assist service providers in understanding the regulatory framework
- if the additional guidance for the use of the response template for the Annual Compliance Order is fit for purpose, and
- comments on the proposed use of AER audit powers.
Interested parties are invited to make written submissions to the AER regarding this proposal by close of business 16 September 2024.
The AER prefers that all submissions be in an electronic format and publicly available. Submissions will be treated as public documents unless otherwise requested. All non-confidential submissions will be placed on the AER’s website.
