The AER is seeking public submissions on Ergon Energy’s application for a ring-fencing waiver from clauses 3.1(b) and 4.2.3 of the Ring-fencing guideline (Electricity distribution).
Ergon Energy applied to us for the waiver on 25 July 2023 and we’ve granted them a limited interim waiver while we consider the application in full.
The waiver application, if approved, would allow Ergon Energy to provide competitive services using its Microgrid and Isolated System Test (MIST) Facility.
This would allow other entities to lease the MIST Facility to test the integration of consumer energy resources, individual battery and inverter systems and control systems.

We prefer to make written submissions publicly available to facilitate an informed and transparent consultative process. We will treat written submissions as public documents unless otherwise requested.

The proposed timing for our consultation and decision is:
- 5 December 2023 – publish Initiation Notice for consultation
- 31 January 2024 – Submissions close
- March 2024 – AER issues decision and statement of reasons
