The National Electricity Rules state that a MLO generator may appoint a MLO nominee to perform the liquidity obligation on its behalf (4A.G.20(b)). When a MLO nominee is appointed, the MLO generator remains wholly responsible for the performance of the liquidity obligation (4A.G.20(c)).

The interim MLO guidelines outline that where a nominee is appointed, the nominee will need to ensure the information provided to a MLO exchange for each trading periods contains the necessary details to ensure the offers can be attributed to the appropriate MLO generator for compliance purposes. The guideline also states that the details of any nominee appointed will be published on the AER website including the details of the appointing party.

During the first 2 years of the RRO’s operation (until 30 June 2021) MLO generators have been deemed in the National Electricity Rules (11.116.12). After this time details of the MLO groups and MLO generators in each region, including any MLO nominees, will be included in the MLO register. The MLO register will be developed and published by 31 May 2021.
