On 5 May 2017, the COAG Energy Council issued the AEMC with terms of reference for a review into the scope of economic regulation applied to gas pipelines. The review focuses on Parts 8-12 of the National Gas Rules which set out how covered gas pipelines are to be regulated. These parts provide the rules in relation to the access arrangement process and information framework, calculation of revenue and prices, non-price terms and conditions of access and the arbitration framework to settle disputes.
The review was prompted by the issues raised in the ACCC's Inquiry into the east coast gas market, which found that pipelines subject to full regulation were exercising market power.
Issues paper
On 27 June 2017 the AEMC released an Issues paper on its Review into the scope of economic regulation applied to covered pipelines.
On 22 August 2017, the AER submitted a submission to the AEMC in response to its issues paper.
