On 9 December 2015, the AEMC received a rule change request from the COAG Energy Council to revise the market participant suspension framework in the National Electricity Rules.
The rule change request proposes to clarify that the suspension of some but not all of the registrations of a market participant is permitted, and to provide for participants that are under external administration to remain in the National Electricity Market in some circumstances.
Consultation paper
On 6 July 2016 we provided a submission in response to the AEMC consultation paper. Our submission supports changes to clarify the market suspension provisions for participants under external administration. Our submission also supports broad discretion for AEMO in making decisions not to suspend a participant in external administration. The submission supports AEMO being able to impose conditions on a participant under external administration to incentivise compliance, and clear consequences for non-compliance.
Draft determination
On 14 October 2016 we provided a submission in response to the AEMC's draft rule determination. Our submission supports the provisions in the draft rule which would enable AEMO to make a non-suspension decision conditional on the market participant continuing to satisfy specified obligations. The submission also supports the clarification in the draft rule that conditions imposed by AEMO in a non-suspension decision must be satisfied in order for the decision to remain in effect. The submission proposed changes to the draft rule to afford greater discretion to AEMO when making a non-suspension decision.
