The limited merits review regime provides for an affected or interested person to apply to the Australian Competition Tribunal for a limited review of our electricity network revenue and pricing determinations and gas pipeline access arrangement determinations. The SCER is reviewing this regime. On 7 March 2012, the Expert Panel (consisting of Professor George Yarrow, Dr John Tamblyn and the Hon. Michael Egan), convened by the Standing Council on Energy and Resources (SCER), commenced a review of the limited merits review regime in the National Electricity Law and the National Gas Law.
In 2012–13 we made several submissions on discussion papers, reports and the regulation impact statement for this review.
Our submissions argued the current limited merits review regime has significant weaknesses that need to be addressed. We supported retaining the Australian Competition Tribunal as the review body.

On 28 August 2012 we provided a response to the review’s stage two discussion paper.
Expert Panel recommendations - Stage Two
On 30 October 2012 we made a joint submission with the ACCC to the recommendations of the Expert Panel in its Stage Two report.

On 7 February 2013 the we provided a joint submission with the ACCC to SCER's Regulation Impact Statement Consultation Paper dealing with the Limited Merits Review regime.
