Under section 10.3 of the gas code the Queensland Gas Pipeline access arrangement drafted and approved by the ACCC in November 2001 applied to the pipeline until the commencement of the National Gas Law on 1 July 2008.
In April 2004 Alinta acquired the Queensland Gas Pipeline from Duke Energy. Following Alinta's acquisition of the Queensland Gas Pipeline from Duke Energy, Alinta submitted to the ACCC voluntary revisions to the access arrangement under section 2.28 of the gas code. The proposed revisions to the access arrangement were approved by the ACCC in February 2005.
Following a financial transaction in 2007, Alinta East and Alinta West split into two companies. Alinta East, which owns the QGP, was acquired by Singapore Power and subsequently renamed Jemena.
The National Gas Law (NGL) and National Gas Rules (NGR) commenced on 1 July 2008 and replaced the Gas Pipeline Access Law and the gas code. The National Gas (Queensland) Regulation 2008 (the Regulation), which is subordinate legislation to the National Gas (Queensland) Act 2008, provides for transitional arrangements under the NGL and NGR for the South West Queensland Pipeline, the Queensland Gas Pipeline and the Carpentaria Gas Pipeline.
The Regulation stipulates that the Queensland Gas Pipeline is no longer a covered pipeline. Consequently, the access arrangement ceases to apply.
