On 29 July 2022, the NSW Office of Energy and Climate Change (OECC) submitted a request for the AER to determine a jurisdictional scheme application.
The AER must consider whether the scheme, under section 58(6) of the Electricity Infrastructure Investment Act 2021 (NSW) (EII Act) and clause 37 of the Electricity Infrastructure Investment Regulation 2021 (NSW), is a jurisdictional scheme under the National Electricity Rules (NER).
The AER is satisfied that this is a jurisdictional scheme in accordance with the NER’s eligibility criteria.
The scheme is part of NSW’s Electricity Infrastructure Roadmap and allows for the implementation of exemptions to costs associated with the EII Act for emissions-intensive trade exposed entities and green hydrogen producers to be implemented through NSW Distribution Network Service Providers.
The AER must assess all requests for jurisdictional schemes under the NER.
This is the second jurisdictional scheme request from NSW OECC the AER has considered this year (we made a decision on the first request on 9 December 2021).
