The Australian Energy Regulator (AER) has today released its Rate of Return information paper, another key document in the AER’s pathway to the 2022 Rate of Return Instrument review, and invites submissions from stakeholders.

The information paper marks the start of the Making the Instrument papers and activities. This will take us from our working papers developed with all stakeholders over 2020 and 2021 to the formal steps before making the final 2022 Instrument. The paper sets out the priority topics that will be the focus of the experts' Concurrent Evidence Sessions in February and provide material to assist stakeholders make submissions.

This submission period is the final opportunity for stakeholders to provide submissions ahead of the draft Instrument which is scheduled to be published in June 2022.

Invitation for submissions

We invite interested stakeholders to make submissions on both our final omnibus paper and the information paper. Written submissions should be emailed to RateOfReturnataer [dot] gov [dot] au (RateOfReturn[at]aer[dot]gov[dot]au) by close of business 11 March 2022.

We prefer that all submissions be sent in an electronic format in Microsoft Word or other text-readable document form and publicly available, to facilitate an informed, transparent and robust consultation process.

We will treat submissions as public documents unless otherwise requested. All non-confidential submissions will be placed on the AER's website. For further information regarding the AER's use and disclosure of information provided to it, see the ACCC/AER Information Policy. We request parties wishing to submit confidential information:

  • clearly identify the information that is the subject of the confidentiality claim
  • provide a non-confidential version of the submission in a form suitable for publication.
