On 20 May 2020, the Australian Energy Regulator (AER) considered and approved Stockland’s application to repeal its individual exemption in accordance with clause 20 of schedule 2 to the National Gas Law.
Background
On 30 July 2015, the AER accepted an application from Stockland for an individual retail exemption for the sale electricity at Bathurst Shopping Centre, NSW.
Submissions closed on 28 August 2015. No submissions were received.
On 27 November 2015, the AER approved an application from Stockland for an individual exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law.
Change of ownership
On 7 December 2018, Retpro Management Pty Ltd / ABN 64 155 736 771 registered retail exemptions for the sale of electricity at this site.
Cancellation of Exemption
On 15 April 2020, the AER received an application from Stockland Property Management Pty Limited to cancel the individual exemption. Stockland requested the cancellation of exemption on the grounds that it no longer owns or operates Bathurst Shopping Centre and does not sell electricity at the site.
The AER, under section 20 of the National Gas Law and section 8 of the National Energy Retail Law, has a general power to repeal any decisions that it is entitled to make.
The process to cancel an individual exemption is similar to the application process. When an application has been accepted it is open to submissions for a minimum 20 business day consultation period, after which time the AER will approve or refuse the application for cancellation.
Submissions on Stockland's application to cancel the exemption closed on 15 May 2020. No submissions were received.
