On 14 October 2013, the Australian Energy Regulator (AER) accepted an application from Express Solar Pty Ltd (Express Solar) for an exemption from the requirement to hold a retailer authorisation under the National Energy Retail Law. We are now seeking submissions from interested stakeholders on Express Solar’s application for exemption.
Express Solar is a solar panel installation business which is seeking to sell energy to small residential and small business customers, though electricity generated via solar panels installed at the customer’s premises (Express Solar will retain ownership of the panels).
Invitation for submissions
We invite submissions from interested parties on the application by Tuesday 12 November 2013.
Submissions should be emailed “Attention: Jacqui Thorpe, Acting General Manager, Retail Markets Branch” at AERInquiryaer [dot] gov [dot] au (AERInquiry[at]aer[dot]gov[dot]au) with the following title in the email: Express Solar Application for Individual Exemption.

We will take into account submissions in deciding whether or not to grant Express Solar’s exemption.
The AER prefers that all submissions be sent in an electronic format in Microsoft Word or other text readable document form and publicly available, to facilitate an informed, transparent and robust consultation process. Accordingly, submissions will be treated as public documents and posted on the AER's website, unless prior arrangements are made with the AER to treat the submission, or portions of it, as confidential. Those wishing to submit confidential information are requested to:
- clearly identify the information that is the subject of the confidentiality claim; and
- provide a non-confidential version of the submission.
