The Australian Energy Regulator (AER) has released a draft decision paper on the fairness and reasonableness of United Energy’s (a Victorian electricity distributor) offer to Sietel Limited for the upgrade of electricity supply at Sietel’s premises in Moorabbin Victoria. The term in contention is United Energy’s offer to Sietel to enter into a 30 year lease with a 30 year option over the land where supply, including new plant, will be provided.
Under United Energy’s Electricity Distribution Licence, if a dispute arises, any question as to the fairness and reasonableness of such terms and conditions is to be decided by the AER. The AER has reached a draft decision that United Energy’s offer, in relation to the term of the lease is not fair and reasonable under the circumstances.
Interested parties are invited to make written submissions regarding the draft decision to the AER by Wednesday, 6 April 2011. The AER will deal with all information it receives in accordance with the ACCC/AER information policy.
