The AER has published an issues paper on its proposed approach to compliance with the National Energy Retail Law, Rules and Regulations, available from its website.
Under the proposed Retail Law the AER will monitor, investigate, enforce and report on the compliance of regulated entities with the National Energy Retail Law, Rules and Regulations. To support these functions, it is likely the Law will provide the AER with wide ranging information gathering powers and require the AER to produce compliance procedures and guidelines.
This issues paper represents the AER's preliminary consultation on its proposed approach to compliance and enforcement under the Law. Responses to the paper will assist the AER to develop its approach to compliance under the retail framework and the development of the compliance procedures and guidelines.
The AER invites written submissions by 12 July 2010. Submissions should be sent to AERInquiryaer [dot] gov [dot] au (AERInquiry[at]aer[dot]gov[dot]au).
Submissions will be treated as public documents and placed on the AER's website unless otherwise requested. For information regarding the use and disclosure of information, please refer to the ACCC-AER information policy: the Collection, Use and Disclosure of Information.
The AER will hold a stakeholder forum via video conference to capital cities in all participating jurisdictions on Wednesday 21 July 2010 from 2pm to 5pm (AEST). To register your participation at the forum, please send an email to AERInquiryaer [dot] gov [dot] au (AERInquiry[at]aer[dot]gov[dot]au) by 1 July 2010, indicating the city in which you will attend. The subject of the email should state "Registration for Retail Compliance Stakeholder Forum - attention Chris Streets". Registration for the forum is essential as spaces are limited. Stakeholders are asked to nominate no more than one participant each.
Further Consultation
The AER is likely to shortly release issues papers on its approach to retail market performance reporting and retail exemptions. Stakeholder forums on these issues have been scheduled for the following dates:
- Performance reporting, Wednesday 4 August 2010 (1pm to 5pm)
- Retail Exemptions, Thursday 19 August 2010 (morning) and Friday 20 August 2010 (morning)
