The Carpentaria Gas Pipeline (CGP) access arrangement contains a 'review trigger mechanism' (clause 8.4) which provides for a review of the access arrangement before the scheduled review date if a specified event occurs.
In 2007 the ACCC commenced inquiries into whether a specified event under clause 8.4 had occurred. The ACCC has continued to monitor the situation in light of the reversal of the flow of gas on the South West Queensland Pipeline (SWQP) and any possible implications for the CGP access arrangement.
In correspondence to the ACCC dated 15 November 2007, the APA Group, the owner of the CGP, stated that in its view the reversal of flow of gas on the SWQP has no implications for the CGP access arrangement. Accordingly, the APA Group submitted that no specified event under clause 8.4 of the access arrangement has occurred that would trigger a review of the access arrangement.
Interested parties are invited to make submissions to the ACCC in relation to this matter, and specifically the issues raised by the APA Group in its letter. Submissions are due by 18 April 2008 and may be sent electronically to aerinquiry
