On 22 November 2024, the AER approved Sustainable Asset Co Pty Ltd’s application for an individual exemption from the requirement to register as a network service provider and the operation of Chapter 5 of the National Electricity Rules (NER). 

The exemption was granted in accordance with clause 2.5.1 of the NER and is subject to the conditions set out in the Instrument of Exemption

Background

On 19 January 2024, the AER accepted an application from Sustainable Asset Co Pty Ltd for an individual exemption to own, operate and control a large-scale embedded network at Oakden Rise, Corner Fosters and Grand Junction Roads, Oakden SA 5086.

Oakden Rise is a 52 hectare, broadacre residential development located 9 km North of Adelaide's CBD that will involve the reticulation of private electrical infrastructure across public roads and easements within the development. 

When completed, Oakden Rise will consist of approximately 1,310 residential dwellings (with each having a minimum 1.5 kW photo voltaic (PV) system installed), a resident's club (common area), large open spaces with parklands, playgrounds and walking trails.

The application proposed residents of Oakden Rise be supplied electricity via an embedded network instead of directly by the local distribution network service provider.

Submissions from interested stakeholders on Sustainable Asset Co Pty Ltd's application closed on Wednesday 21 February 2024. Four submissions were received.
