The National Electricity Rules (NER) and the National Gas Rules (NGR) each create an alternative dispute resolution framework for the non-litigious management of disputes between energy market participants, and between energy market participants and the Australian Energy Market Operator (AEMO).
Under the NER and NGR the AER must appoint an independent Dispute Resolution Adviser to administer these frameworks.
On 8 February 2021, the AER released a Request for Tender AER reference: AC 13/21 to appoint a Dispute Resolution Advisor. This process is still underway and the new arrangement is scheduled to commence on 1 October 2021. Until such commencement, the AER has extended the incumbent Dispute Resolution Advisor to 30 September 2021 as an interim measure.
