The Australian Energy Regulator (AER) has publicly released the access arrangement proposal submitted for the Jemena Gas Network (NSW) Ltd for the period 1 July 2010 to 30 June 2015 for consideration and comment by interested parties.

The access arrangement proposal establishes the basis for the terms and conditions of access for users and prospective users for the pipeline.

The AER is required to make the decision to approve or not approve the access arrangement proposal. The AER is required to publish the draft and final decisions on the AER’s website.

The AER is seeking submissions on the access arrangement proposal for Jemena’s NSW Gas Network for consideration in making its draft decision on the proposal.

In providing a submission, interested parties may wish to comment on:

  • Use of the Fama–French Three Factor Model to determine a WACC
  • Changes to the tariff structure for volume customers as well as changes to the tariff variation mechanism to include amongst other things a weather adjustment factor
  • The proposed incentive mechanism and considerations of its impact if applied.

Submissions may be sent electronically to nswactgasataer [dot] gov [dot] au (nswactgas[at]aer[dot]gov[dot]au) by 5 pm A.E.D.T on 10 November 2009.

Interested parties are referred to the AER’s access arrangement guideline for further details on how to make submissions to the AER at the AER's website.

The AER may, but need not, consider a submission it receives after the consultation period has ended.

Decision making time

The AER is required to make its decision on this proposal within six months of receipt but it can stop this clock while receiving submissions on the proposal.

The AER has decided a period of 56 days for consultation on the proposal is not counted towards the decision making time for the full access arrangement final decision.
