On 25 November 2009 the Australian Competition Tribunal (Tribunal) made orders varying some aspects of the Australian Energy Regulator’s (AER) New South Wales distribution determination 2009–10 to 2013–14. One element of these orders was that the AER’s decision in respect to EnergyAustralia’s alternative control (public lighting) services be remitted back to the AER to make the decision again in accordance with the Tribunal’s directions and taking into account submissions from EnergyAustralia and other interested parties.
The Tribunal has directed the AER to undertake its redetermination in accordance with the following timetable:*

On 7 January 2010, EnergyAustralia submitted its public lighting services proposal together with supporting information to the AER. In accordance with the Tribunal’s orders, the AER has published EnergyAustralia’s non confidential public lighting services proposal and supporting information on its website.
The AER is currently reviewing information claimed to be confidential by EnergyAustralia against the requirements of the National Electricity Law.
Invitation for submissions
Interested parties are invited to make written submissions on EnergyAustralia’s public lighting services proposal by 4pm Thursday, 21 January 2010.

The AER prefers that all written submissions be publicly available to facilitate an informed and transparent consultative process. Submissions will be treated as public documents unless otherwise requested. Parties wishing to submit confidential information are asked to provide both confidential and non-confidential versions of their submission. All non-confidential submissions will be placed on the AER’s website. Submissions will be dealt with in accordance with the AER’s information policy, which is available on the AER’s website.
The AER may, but need not, consider a submission it receives after the consultation period has ended.
