Today the AER released its proposal to make an updated Annual Compliance Order (ACO) as a general regulatory information order under section 48(1)(b) of the NGL. The order is used to obtain information and documentation from pipeline service providers to ascertain compliance with their general and specific duties.
We are seeking feedback on a number of issues, including:
- whether the information sought in the ACO is clear and understandable
- whether the template for responses to the ACO is accessible and fit for purpose
- the level of assurance sought for information provided as contained in clause 5
- the scope of the information sought in the draft ACO, and
- the anticipated burden on businesses in compiling a response to the ACO.
Interested parties are invited to make written submissions to the AER regarding this proposal by close of business, 12 March 2024.
The AER prefers that all submissions be in an electronic format and publicly available. Submissions will be treated as public documents unless otherwise requested. All non-confidential submissions will be placed on the AER’s website.
