The Australian Energy Regulator (AER) administers the (Queensland) Electricity Distribution Ring-Fencing Guidelines (the Guidelines) under the National Electricity Rules.
On 17 January 2014, the AER received an application from Ergon Energy to waive obligations under section 1(b) of the Guidelines. This section requires that a DNSP that provides prescribed distribution services in Queensland must not carry on a related business within that legal entity. The waiver application relates to the ownership and operation of a 1.0MVA grid-connected generation option constructed by Ergon Energy for network support in the Mount Isa region to alleviate identified network constraints.
Invitation for submissions
The AER invites written submissions on Ergon Energy’s waiver application by close of business on Friday, 14 February 2014. Submissions can be sent electronically to AERInquiryaer [dot] gov [dot] au (AERInquiry[at]aer[dot]gov[dot]au) with the following title in the email: Ergon Energy - application for ring fencing waiver.

The AER prefers that all submissions be sent in an electronic format in Microsoft Word or other text readable document form and publicly available, to facilitate an informed, transparent and robust consultation process. Accordingly, submissions will be treated as public documents and posted on the AER's website unless prior arrangements are made with the AER to treat the submission, or portions of it, as confidential. Those wishing to submit confidential information are requested to:
- clearly identify the information that is the subject of the confidentiality claim; and
- provide a non-confidential version of the submission.
