On 19 November 2010, SPI Electricity Pty Ltd (SP AusNet) applied to the Australian Competition Tribunal (Tribunal) for review of various parts of its 2011–15 distribution determination. One part of that review concerned the definition of the insurance pass through event that was included in SP AusNet’s 2011–15 distribution determination pursuant to clause 6.12.1(14) of the NER.
On 5 April 2012, the Tribunal ordered that the insurance pass through event decision be remitted to the AER to be remade. The Tribunal’s reasons remain confidential and a brief description of the issue can be found at paragraphs 533 and 539 of the Tribunal’s reasons for decision in Application by United Energy Distribution Pty Limited [2012] AcompT 1.
In accordance with NER, the AER has made its draft decision remaking the decision regarding the definition of the insurance pass through event for SP AusNet.
Invitation for submissions
The AER invites submissions from stakeholders on the AER’s draft decision.
Interested parties are invited to provide written submissions to the AER by close of business Wednesday 12 September 2012.

The AER prefers that all submissions be sent in an electronic format in Microsoft Word or other text readable document form and publicly available, to facilitate an informed, transparent and robust consultation process. Accordingly, submissions will be treated as public documents and posted on the AER's website, except and unless prior arrangements are made with the AER to treat the submission, or portions of it, as confidential. Parties wishing to submit confidential information are requested to:
- clearly identify the information that is the subject of the confidentiality claim; and
- provide a non-confidential version of the submission
