The AER is required under Chapter 6A of the National Electricity Rules (NER) to make a transmission determination for TransGrid in relation to the New South Wales electricity transmission network. The determination will establish network charges for the period 2009-2014.

On 2 June 2008, TransGrid submitted its revenue proposal, proposed negotiating framework and proposed pricing methodology to the AER.

The AER conducted the preliminary examination of TransGrid's proposal required under clause 6A.11.1 of the NER and found that it satisfied the requirements of the AER's Submission Guidelines and the NER.

The AER's proposed negotiated transmission service criteria

Under clause 6A.9.4 of the NER the AER's transmission determination for TransGrid must set out the Negotiated Transmission Service Criteria (NTSC). The NTSC will be applied by TransGrid to negotiate the terms and conditions of access for negotiated transmission services and access charges. Negotiated transmission services include: connection services including entry, exit and TNSP to TNSP connection services; use of system services supplied by the shared transmission network that exceed or are below the networks specified performance standard under any legislation of a participating jurisdiction; use of system services relating to augmentation or extension for loads of the transmission network. The NTSC will also be used by a commercial arbitrator in resolving any dispute between TransGrid and a person wishing to receive a negotiated transmission service.

The NTSC determined by the AER must give effect to, and be consistent with, the negotiated transmission services principles set out in clause 6A.9.1 of the NER.

Public forum

The AER wishes to advise interested parties of its intention to hold a public forum on the proposal submitted by TransGrid on Wednesday, 30 July 2008 in Sydney.

The public forum will provide an opportunity for TransGrid to explain its regulatory proposal. Stakeholders will also have an opportunity to ask questions on the regulatory proposal.

Details regarding the public forum will be made available by the AER in a separate notice.

Interested parties are invited to provide written submissions on TransGrid's proposal and the AER's proposed NTSC to the AER by close of business Friday, 8 August 2008.
