AER releases the Confidentiality guidelines issues paper as a part of the Better Regulation reform program.
On 10 December 2012 the Australian Energy Regulator (AER) released its issues paper for consultation on the Better Regulation reform program in 2013.
Today the AER has released an issues paper on the Confidentiality guideline for consultation as part of the Better Regulation reform program 2013.
The Confidentiality guideline sets out how confidential information will be considered for regulatory determinations. The guideline will cover the types of information that is considered confidential and the process for disclosure to ensure more information is available for stakeholders to engage in the regulatory determination process.
Invitation for submissions
Interested parties are invited to make written submissions to the AER regarding this paper by the close of business, 14 May 2013. Submissions should be sent electronically to: confidentialityaer [dot] gov [dot] au (confidentiality[at]aer[dot]gov[dot]au). Alternatively, submissions can be sent to:

The AER prefers that all submissions be publicly available and sent in an electronic format in Microsoft Word or other text readable document form, to facilitate an informed, transparent and robust consultation process. Accordingly, submissions will be treated as public documents and posted on the AER's website, unless prior arrangements are made with the AER to treat the submission, or portions of it, as confidential. Those wishing to submit confidential information are requested to:
- clearly identify the information that is the subject of the confidentiality claim; and
- provide a non-confidential version of the submission
Confidentiality guideline stakeholder forum
The AER will host a stakeholder forum on the confidentiality guideline on 4 April 2013. Further details of the forum will be notified in due course to those that have registered an interest in this guideline. Those wishing to register are encouraged to do so by sending their details to confidentialityaer [dot] gov [dot] au (confidentiality[at]aer[dot]gov[dot]au).
