The Australian Energy Regulator has today published our final Day Ahead Auction Record Keeping Guideline – Version 2 (Guideline).

This Guideline sets out how facility operators and transportation facility users must record and maintain nomination and renomination data relevant to the AER’s monitoring functions. The changes address concerns identified by the AER with participant reporting since it published the initial guideline upon the Day Ahead Auction’s commencement in 2019.

The final amendments to the Guideline include enhanced data submission protocols to ensure the accuracy, completeness, and timeliness of records. These amendments support the requirement that transportation facility user renomination records must be verifiable and specific. 

The Guideline aims to enhance the quality of information received and to aid facility operator and transportation facility user compliance with the National Gas Rules (NGR) and the National Gas Law (NGL). 

The revised Guideline will come into effect on 1 March 2025, allowing for a seven-month implementation period. This implementation period will enable gas market participants to ask any questions they have prior to the Guideline coming into effect and to make any changes required as a result of the final amendments to the Guideline.

Background

The AER sought stakeholder feedback on two occasions on the proposed amendments to the DAA Record Keeping Guideline, in April 2023 through a consultation paper and in June 2024 through a draft decision. The AER received a total of 12 submissions and used these to formulate the final amendments in the final decision.

The AER is responsible for monitoring and enforcing compliance with various obligations in the National Gas Law, National Gas Rules, and guidelines, including the monitoring of auction behaviour to ensure that shippers do not make false or misleading nominations and renominations.
