The AER has today published two guidance notes to assist NSW coal miners and power stations understand their compliance obligations with Coal Market Price Emergency Directions made by the New South Wales Minister for Energy under the Energy and Utilities Administration Act (NSW) 1987 (Act).
Background
The two guidance notes are linked to the new monitoring, compliance and advisory powers the AER acquired in February 2023, following Energy Ministers agreeing to interventions in wholesale gas, coal and electricity markets.
The AER is appointed as a regulator under the Act and tasked with monitoring compliance and enforcement of the directions to ensure NSW coal mines and power stations comply with directions and enable reporting on the impacts of the market interventions.
